1. Agreement to Terms

By booking and using our infrared sauna rental service, you agree to these Terms & Conditions. These terms are governed by the laws of New Zealand.


2. Consumer Guarantees Act 1993

Nothing in these Terms & Conditions limits or excludes your rights under the Consumer Guarantees Act 1993 where the service is supplied for personal, domestic, or household use.

If you are booking for business purposes, you agree that the provisions of the Consumer Guarantees Act may not apply, as permitted under New Zealand law.


3. Booking & Payment

  • Full payment (or agreed deposit) is required to confirm your booking.

  • Prices are listed in NZD and include GST 

  • We reserve the right to cancel bookings where payment has not been received.


4. Delivery & Installation

  • We will deliver and set up the sauna at the agreed address.

  • You must provide safe and clear access to the installation area.

  • The sauna must be placed on a flat, stable surface.

  • A suitable power supply must be available as advised prior to booking.

Under the Health and Safety at Work Act 2015, we may refuse installation if conditions are unsafe.


5. Health & Safety

You acknowledge that:

  • Sauna use involves exposure to elevated temperatures.

  • You use the sauna at your own risk.

  • You must follow all safety instructions provided.

Do not use the sauna if:

  • You are under the influence of alcohol or drugs

  • You have certain medical conditions without consulting a healthcare professional

  • You are pregnant without medical advice

Children must not use the sauna without adult supervision.


6. Responsibility During Rental Period

You are responsible for the sauna from the time of delivery until collection.

You agree to:

  • Use the sauna only as instructed

  • Not modify, dismantle, or relocate the unit

  • Keep the sauna protected from damage, misuse, or theft

You may be liable for repair or replacement costs for damage beyond fair wear and tear.


7. Equipment Faults

If the sauna becomes faulty during your rental:

  • Contact us immediately.

  • Do not attempt repairs.

Under the Consumer Guarantees Act, you are entitled to a remedy if the service is not provided with reasonable care and skill. Remedies may include repair, replacement, partial refund, or full refund depending on the situation.


8. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • We are not liable for indirect or consequential losses.

  • We are not liable for injury or loss caused by misuse or failure to follow safety instructions.

Nothing in this clause limits liability where it cannot be legally excluded under New Zealand law.


9. Cancellation & Refunds

We understand that plans can change. However, due to preparation, scheduling, and transportation requirements, the following cancellation terms apply:

  • Cancellations made 48 hours or more prior to the booking may receive a full refund (excluding any non-refundable deposit, if applicable).

  • Cancellations made within 48 hours of the scheduled session may result in partial or full forfeiture of payment.

  • Cancellations made within 24 hours of the booking are non-refundable.

Rescheduling requests made within 24–48 hours may incur a rescheduling fee at the discretion of My Sauna.

Failure to provide safe or suitable access for setup at the agreed time may be treated as a late cancellation.


10. Privacy

We collect and store personal information in accordance with the Privacy Act 2020 (NZ). Personal information is used solely for booking, communication, and service delivery purposes.


11. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.
